These Terms of Use govern your use of the Chill app (the “App”), which is provided by Younes Bensitel (“we,” “us,” or “our”). By downloading or using the App, you agree to be bound by these Terms of Use.
- License and Restrictions
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or transfer any part of the App or its intellectual property rights. You may not attempt to extract the source code of the App or create derivative works based on the App. All trademarks, copyrights, database rights, and other intellectual property rights related to the App remain our property.
- User Conduct
You may use the App only for lawful purposes and in accordance with these Terms of Use. You may not:
a. Use the App in any way that violates any applicable federal, state, local, or international law or regulation;
b. Engage in any conduct that restricts or inhibits any other user from using or enjoying the App;
c. Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with any person or entity;
d. Upload, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, vulgar, or otherwise objectionable;
e. Upload, transmit, or distribute any content that infringes any patent, trademark, trade secret, copyright, or other intellectual property right of any other person or entity;
f. Use the App to transmit any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation;
g. Use the App to transmit any material that contains viruses, Trojan horses, worms, time bombs, or any other harmful or malicious program;
h. Use the App to harvest or collect any information about other users of the App without their consent.
- Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” WITHOUT ANY WARRANTIES OR GUARANTEES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, THAT THE RESULTS OBTAINED FROM USING THE APP WILL BE ACCURATE OR RELIABLE, OR THAT ANY ERRORS IN THE APP WILL BE CORRECTED.
- Limitation of Liability
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR DATA. OUR LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP.
- Intellectual Property Ownership
All trademarks, copyrights, database rights, and other intellectual property rights related to the App and its content, including but not limited to text, graphics, images, and software, are our property or the property of our licensors.
- Governing Law and Jurisdiction
These Terms of Use governance will be determined according to a series of principles and regulations depending on whether the dispute concerns EU member states or non-EU member states.
- Indemnification
You agree to indemnify, defend, and hold harmless us and our affiliates, officers, directors, employees, agents, and licensors from and against any claims, actions, demands, damages, costs, liabilities, and expenses, including reasonable attorneys’ fees, arising out of or in connection with your use of the App, your violation of these Terms of Use, or your violation of any rights of any third party.
- Termination
We may terminate your access to the App at any time and for any reason without prior notice. Upon any termination, (a) the license granted to you in these Terms of Use will end; (b) you must stop using the App, and (if needed) delete it from your device.
- Age Restrictions
The App is intended for use by individuals 13 years of age or older. If you are under 13 years of age, you may use the App only with the involvement of a parent or guardian.
- Subscription
The App is free to download and use, but certain features of the App are only available through a subscription. The subscription is renewable and can be paid through the App Store. By subscribing to the App, you agree to pay the applicable subscription fee, which will be charged to your iTunes account at confirmation of purchase. The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage your subscription and turn off auto-renewal by going to your Account Settings after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
- Severability
If any part of these Terms of Use is deemed invalid or unenforceable, the remaining provisions shall remain in effect.
- Changes to These Terms of Use
We may update these Terms of Use from time to time without prior notice. The most current version of these Terms of Use can be viewed by clicking on the “Terms of Use” link within the App. Your continued use of the App after any changes to these Terms of Use constitutes your acceptance of the revised Terms of Use.
